Double D Mobile Application Terms of Use

Double D Transportation Co., Inc. is pleased to provide you with access to the Double D Mobile App to expedite the collection of freight bills and improve the Double D experience for our clients, subhaulers and brokers. By accessing the App, you agree to be bound by these Terms of Use. We may update the Terms of Use from time to time, so please review the Terms of Use to stay informed of such updates. 

You are granted a limited, revocable license to use the App. The information provided on the App is solely intended for your use, and is not to be copied or distributed without our express permission. The App is our proprietary property, and all Content and Marks are protected by applicable law. 

You are required to register with the App. You agree to keep your password confidential. You are responsible for all use of your account and password. You consent to receive electronic communications via the App. 

You are solely responsible for all data you submit via the App, and represent such information will be true and accurate. You may not access or use the App for any purpose other than that for which we make the App available. You are solely responsible for determining the proper routes and compliance with local laws and regulations. 

These Terms of Use shall remain in full force and effect while you use the App. We cannot guarantee the availability of the App. We may experience hardware, software, or other problems or need to perform maintenance related to the App, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the App without notice. 

These Terms of Use and your use of the App are governed by the laws of the State of California. Any dispute or claim related to your use of the App, with the exception of intellectual property rights, will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, which are available at www.adr.org. If for any reason a dispute proceeds in court rather than arbitration, you consent to the jurisdiction of the state and federal courts located in Alameda County, California.

THE APP IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APP AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO REPRESENTATIONS OR WARRANTIES AND ASSUME NO LIABLITY AS TO THE ACCURACY OR COMPLETENESS OF THE APP’S CONTENT. To the fullest extent permitted by law, you agree to defend, indemnify, and hold us harmless, including our owners, affiliates, officers, employees, and agents, from and against any loss, damage, liability, claim, or demand, including reasonable attorney fees and expenses, made by any third party arising out of your negligent use of the App.

These Terms of Use constitute the entire agreement between you and us regarding use of the App. Our failure to enforce any provision of these Terms of Use will not operate as a waiver of such provision. These Terms of Use operate to the fullest extent permissible by law. We may assign our rights and obligations to others at any time. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. Use of the App does not create an employer-employee or joint employer relationship of any form.
